    Anyone following the cap count would see that H1B numbers have gone down from 45500 to 44400 in one week. Since obviously even if no one submitted an H1B applicn last week, the only way numbers could have gone down is if USCIS denied 1100 applications. Seems like a high number of rejections in one week. My guess is these numbers reflect the the RFE(impossible to reply RFEs) cases that were sent to the premium processing and a few regular processing cases that ran out their time limit and got denied. It will be funny( for the anti immigrants) to see if the Cap count numbers continue to go down and guess by sept 2010, the numbers still available in the quota would be around 60k?!?
    Just another example of the ruthless and cold hearted stand that USCIS is taking towards highly* skilled immigrants.

    My six-year H1B expires Feb 2 2010.
    My employer (company A) filed PERM with DOL on July 30 2009.
    I have spent a total of 2 months outside the U.S while on H1B status.
    I have been on bench since July without paystub.
    I am leaving the U.S on October 30 2009 and am interested in returning back
    through another company

    Can I return to the U.S through another employer (company B) on a new H1B visa after Feb 2 2010... How long would that visa be valid for.

    If I cannot get a new visa; can I add the total of 5 months spent outside
    the US on the current h1b visa for recapture through another employer (company B) after Feb 2 2010 -- return to the U.S; and then
    subsequently apply for a 1-year extension after July 31 2010
    based on company A's PERM filing.

    Currently I�m holding h1 and same time has AOS with my existing employer. I�m continuing my employment based on h1 and use Advance parole for travel purpose. My employer mentioned about not revoking I-140, even if I move to new employer. Since with new client, I�m transferring my H1 visa, I have 2 options with regard to my AOS portability

    1) Either just transfers my h1 without porting AOS with new client. Continue with my AOS with old employer, since he won�t revoke my I-140 and provide support for future employment.

    2) H1 transfer and Porting my AOS with new client and it does require my job and description mentioned in I-140 matches with current offer.

    I would really appreciate, if you provide your valuable suggestion/recommendation. The best option to go ahead with.

    People,

    I filed my I-140 at NSC, but when I check case status online it says my I-140 was transfered to another Service center. It does not say which Service center though. My lawyer says he got all his mails form CSC, which means my I-140 is pending at CSC. Also my case number starts with WAC-XXX-XXXX, which also suggests that my case is pending at CSC. However, I am not convinced if this is correct because CSC does not publish processing times for I-140. Also, recently when I filed AR-11 for an address change I got an email from USCIS with the address of TSC on it. I would like to know if anyone is in the same boat and knows which service center there case is. I will appreciate your feedback.

    i485 rfe for my wife. Please help

    My wife received an rfe for the things listed below. I think she got it because her finger prints are not machine readable and FBI have not been able to verify it....



    1) Submit true certfied copies of any and all arresting officers reports....blah blah blah


    2) Other: Local police clearance Letter from every place you have lived in united states

    My wife has been in US close to five years and lived in 2 cities

    MY question is

    for 1) she has never violated any law so does not have court disposition or anything of that sort so does she need
    anything for this?

    for 2) She has resided in 2 cities but also stayed in India for 4 months.
    The rfe clearly says "for every place lived in united states"
    so I would think she does not need a police clearance certificate
    from India


    Please help we have till march 5th to reply this RFE

    For my 9th year H1-B visa extension, i want to use the premium processing. All the attorney fee and any other expenses will be paid by my company. I want to pay only the $1000 for premium processing. Is this legal ? Can the attorney attach my $1000 check signed by me, to the visa extension application with all other paperwork and send it to BCIS ?

    If this is not legal what are my options ?

    Please let me know.

    One of my friend's I-485 with priority date of Jan 2006 got approved yesterday. They have posted the documents to USCIS for his wife early this month(as per his attorney) to link to his I-485, but the check was not cashed yet and receipt notice was not issued for his wife.

    Will there be any issue in this regard? What will be the options for him just in case if the attorney has not sent the documents to USCIS for his wife or the documents get rejected for some reason? Any help/advice in this regard is really appreciated. Thanks.

    Hi all,


    I am a consultant working on H1B and my 3rd yr of visa expires in march 2011.
    Im planning to file my GC through my current employer in EB2 category(As I have a masters degree) but have following queries :

    1.My company is a small company with only 2 employees i.e. me and my manager.
    If i do file my GC through such a company,whats are the pros and cons e.g. any RFE expected because its a small company considering that have already had an RFE when transferring my H1B to this company earlier.


    2.Can I file my GC through a different employer say my end client or any other company while im working with my current employer?

    3.Considering the above situations,what is the best option for me to file my GC at tis point of time?

    Also filing my GC in EB2 category will help avid processing delays as per the current trend?

    Please advise.

    I am nearing the five years on my H1B. My company (A) had it extended with my I-i40 approval. I want to know at this point is it okay to transfer h1B visa to another company (B)? I was told i can only get 9 month extensions with the transfer is that true? Also what if my company (A) cancels my GC process after transferring to company (B), do i have to go through the entire GC process again once I transfer to company (B)? I was told i only have to re apply the I-140 with the priority date given on the previous I-140?

    hello, i really need some one to clarify this information for me.

    when i first started working with my company i did not have work authorization and basically said i am a US citizen, i never had any problems for 4 years, i am a permanent residence now and got my green card this year. the company now nows that i lied 4 years ago when i got hired and i was not allowed to work but am fully eligible to work now becaue of change in status to PR. can the company resubmit a new i9 form with the correct information and if i will be in any trouble with USCIS.

    What is the law for someone who worked illegaly but got his or her status changed to PR.

    You read that correct. Your stay is legal until the decision on your case is done. It is nothing to do with your I94

    the quick answers. Draw your shapes in the extrusion editor with the pencil tool. Outside shape of the hex nut and inside shape. If you get the shape you want, it will be a nice hex nut when you return to scene editor.

    The right answer: Draw in illustrator and save your self the headache of drawing to draw anything outside of simple primitives in swift.

    The even better answer. Any other true modeling program will provide better results. (from 3d paint, 3ds, maya, etc..)
