Hi,
Apologize for starting new thread, but this is an urgent request and need attention.
I need to respond to a RFE related to proving Programmer Analyst being a Speciaity occupation.
I researched and found a memo from Terrance Way, Director INS issued a memo on this on December 22, 2000 and is available on AILA Infonet
AILA InfoNet at Doc. No. 01040603
I couldnt locate this memo in USCIS policy guidance memoranda search.
Can some one with access to AILA Infonet, please send me this document

I am the principal beneficiary and my husband is my derivative, however he got his fp (On july 12) and I haven't received mine!
Should I go with him and try to get fp? I am afraid they wont let me do it, because I only have the case #'s from the back of the checks, i dont have receipts yet!
The only thing we got so far is hi fp notice

The Cap seem to be moving slowly in the past few months, but something is different with the release of the new count this week.
As of September 18, 2009, approximately 46,000 H-1B (http://www.h1b.biz/lawyer-attorney-1137085.html) cap-subject petitions and approximately 20,000 petitions qualifying for the advanced degree cap exemption had been filed. It seems that some employers are hiring again and willing to file for H1B visas for specialty workers. This is a good sign, but this also means that visas may run out sooner than expected.
USCIS will continue to accept both cap-subject petitions and advanced degree petitions until a sufficient number of H-1B petitions have been received to reach the statutory limits, taking into account the fact that some of these petitions may be denied, revoked, or withdrawn.

My PD is 02/2004 EB2-India, and I will be current in June. However, as noted by multiple folks, there is a chance that EB2-India might retrogress during the rest of the fiscal year.
Have folks had luck with an InfoPass interview so push your case? I am afraid that without any encouragement my case will just languish on somebodys desk or in a box.

Hi I heard there are 2 catagories in L1. Managerial /executive and the other one is highly skilled. Where you in the first catagory which does not require the labor certification? or did you have to get the LC?

Hello,
I am working in New Jersey(8th yr H1B extension) and my Employer is in Illinois. In my H1B LCA he mentioned Prevailing wage for New Jersey and Illinois.
1.My Employer is deducting tax from Illinois instead of New Jersey in
my Pay Slip. Can you please tell me which Prevailing wage I need to
compare in this situation?
2.Do I need to compare Gross pay of every month with the amount
mentioned in LCA or total amount (including all Bonus amount).
Please advise me .

IV Members,
I am not able to figure out if this new Merit Based System (if implemented is good or bad for us)
If the guys who already have made some progress using the existing system are asked to re-apply under this new merit based system, it is going to be bad for them, because they have to go through the entire process again.
What about people like me, who are new commers to US ?
If I apply under the new merit based systems, am I automatically subjected to backlog, because people who applied for GC under the previous system have not yet gotten their GCs, or this new merit based system will have its own quote ?
Can anyone explain ?

Good question. I'm not sure if the two-year home residency requirement applies to tourist visas.
But if your J-1 program isn't subject to the two year residency requirement, I don't see why there would be a problem.

AILA's total membership = 10,000 lawyers (including non practising law faculty)
25 Billion dollars divided by less than 10K lawyers, each was going to walk away with a 2.5 million dollar bonanza
Now that it is clear that they will not turn into instant millionaires (believe me, most of them already are), they have suddenly become the EB community's stalwart best friend and are even filing a lawsuit for us because the thought of returning the 2000$ fees for filing 485 is killing them. They may even shed a tear at our sorry plight.

I am EB3 - Dec 2004 filer and there is no hope for few years that my date get current. i have filed another GC through my sister in May 2006 and that F4 category is moving quicker and expecting my priority date will be current in 5 years through my sister.
i have bought 2 Family house in Jersey City. now for my kids education we thought to move to India for 4 to 5 years until we get call for GC though my sister.
we are going to rent house - it's multi family near NYC. my landloard is willing to take care of it in our absence.
my Q is can we get B1 (Visitor visa) for 10 years , if we show that we have property in US and we may need to visit just to take check it ??
should we inform immigration officer about GC filed though my sister to assure that we will not stay in US longer, to get B1 visa?
can we get visitor visa before leaving USA? i mean converting from H1 to B1 for multi year?
i would appreciate some suggestions.

While renewing, on the form, there are 2 questions:
14 Current Immigration Status
15 Manner of Last Entry
(both seem to have the same answer)

When applying for the third stage you can include applications for spouse and children irrespective of the type of visa they are currently in.
