Yes, you don't have to be in the US while the 485 is pending. You will need to be here for any appointments - fingerprinting, interview, etc. You also need to intend to be a permanent resident and work in the position listed on the I-140 (assuming this is an employment-based case). CIS might issue an RFE on the 485, asking for evidence of this, so you need to be able to provide it.

I received a status update email from USCIS yesterday on my wife's pending I-485 application. The status says "On November 5, 2007, the post office returned the notice we last sent you on this case I485 as undeliverable�.
The status used to say "application is pending" as recently as a week ago. If some notice had indeed been returned to them, wouldn't the status have changed around Nov 5, 2007? Could this be an erroneous online status change? We completed our FP back in Oct 2007. we have received EAD, AP, etc. on our address properly, and haven't moved.

Hi,
My employer filed for I-140 and I-485 last year July. My I-140 got approved with a labor converted from RIR.
I want to know the priority date in the approved I-140. But the employer is not giving me copy of I-140. I called USCIS and they say they cannot give the information to be.
How do i get my priority date now?
I have I-140 and I-485 receipt numbers.
Can you find it thru I-485 receipt number?

What is the best way to save one from going out of status on E-3 visa?Can a E-3 Visa holder or E-3D visa holder may apply and successfully get EB-3 or EB-2 green card?Can E-3 visa holder may work for two employers (already USCIS approved extension petition from both) simultaneously (without filling any new I-129 or extension request)?
The place of birth for E-3 Visa holder is Pakistan.

Hello all, my Labor Cert was filed in late 2004 under the RIR regime. Was later "re-filed" under PERM in Oct. 2005. I am an EB-2 candidate (Indian citizen).
The DOL denied the application for Labor Certification filed under PERM recommending that the requirements for the position offered include the phrase " any suitable combination of education, training and experience is acceptable" The denial offers both the option of filing a motion to reconsider and refiling the application with the amended requirements. The law firm hired by my employer has filed a "motion to reconsider". In addition they are in the process of re-filing the application with the amended requirements. My question is-how quickly (from your experience) does the DOL take to respond to the motion to reconsider (my lawyers referenced a memo sent out earlier this year from the DOL in which a 3-4 month timeframe was mentioned).

My I 485 is pending since filing in July 2007 (Receipt Date SEPT2007) Priority date in FEB2006 (EB2). I was wondering if I can change employer. I do work for client but sponsor/employer is keep on exploiting my situation, with same employer for almost 10 years now. I am really fade up. My Friend is having business and if client for whom I have been working with through my employer, ready to get new contract with Friend, then Can I change employer ? In fact relative owns business in Laundry. Is it possible , if client ready to sign contract with relative?In that case my end job is same but since through an employer who would be having different business, do not know whether it is a good idea or not ? If yes, what are limitation and demerits, time involved. Please advise.

For those of you who already went through this process,can you please advise what are the chances for someone in Hungary to immigrate to US on a H1B visa?
The person I'm talking about is Hungarian, has an MBA from a Hungarian University (BA in Management), 5 years professional experience within multi-national companies (currently employed by one). Although he is trying to move to US through L1 he's also interested in the H1 path for a different company.
What are currently the chances for H1B and what is the best way of finding a sponsor?

My case: NIW 140 approved, PD 2006/10, now 485 pending. But I am leaving USA to another country for a permanent job. I am not sure if I should withdraw the 485 or just convert it to CP.
1. Will it be possible for me to get the green card thru CP if I get interviewed and can't show any ties with USA? Can I enter USA during CP? I hope to have green card in case I don't like my new job and come back to US someday. But I may just cancel 485 in order to affect the least my future visiting visa application. Suggestions?
2. I am on H1 now, but H1 will expire 1 month before I leave USA. So I understand that I can stay legally on AOS for the one month, true? Do I need to do anything for switching from H1 to AOS? Again, I need to come back to USA for business/visiting, so I want to do everything right not to harm my future non-immigrant visa application.

I first off apologize if there is already a thread pertaining to my questions. If so I would greatly appreciate being directed.
My situation is this...I came to the US as a visitor from Canada. As a result I did not need a I-94, a visa or a passport since i travelled by car. I am going to be married to a US citizen in a couple of weeks. I guess my questions are these...#1. Since I did not need any of those documents to enter the US, will this cause a problem while trying to prove status?
#2. I read somewhere about filing a I-30 prior to other documentation such as the I-485 and medical and so on. I was wondering if this is true or if i even need to file this document or if so if it can be filed in conjunction with the others.

Is this the second or subsequent request for an extension of stay that you have filed for this alien?
This application is an extension (for 3 years) for my H1-B. My position in the company is the same as that when applied for my previous (first) H1-B petition.
I have NOT applied for green card/labor certification.
Is the answer Yes or No for this question?

I know I have time and things can change, but it seems like they are becoming more difficult. Hence if there are people out there who have ideas, experiences and information to share about what the process is like for potential psychologists to get sponsored, I would greatly appreciate your reply.

LCAs for consultatnts definitely are challenging, since they move around so much. In your case, a new LCA is not required because the new position is in the same Metropolitan Statistical Area (basically the same town) as the old location.
In general, CIS and DOL distinguish between employees who are roving as part of their job, and those who are sent to a new location for a short term. The distinction is too complicated to go into here, but hopefully your company's attorney is well aware of it.
