Hi,
I have an EB2 I-140 approved with priority date of July 2006, but also recently got EB3 I-140 approved with priority date of May 2003.
Even though the dates are current, but it may retrograte in coming months, so Can I file I-485 using my approved EB2 with the priority date of EB3.
Please advice.

Hi Folks
just got my GC. Now if I contract for a security clearance job, like Armed forces, or Defense related one through the same employer that sponsored by GC, CAN I BE ELIGIBLE for a waiver of the 5 years waiting period -to what extent is is waived ....100% or only part of the 5 years wait, if at all .
My Company is a US Defense Vendor .
Can someone pt me to the right place where all this is clarified.
Also would the same kind of waiver apply if you work for a Govt agency or it is strictly defense...
are there some other ways where GC-> Citz can be expedited

I believe working on 1099 is allowed when you have the full time work on H1B going.
There are different types of 1099. 1099-Misc is not allowed. 1099-Int , 1099-G are the examples of allowed 1099s

Does anyone know if EAD renewal requires an employment at the time of renewal? My I140 have been approved and I485 pending for long time under EB2-NIW. Also, do I loose legal status to stay in USA if I lost employment while my I485 pending. Again, my GC application is not company sponsored, it was all by myself. Do I stay in right status even I become unemployed while my I485 pending. My I485 will be pending for few more years due to retrogession. So I am wondering if I can stay as unemployed for a period of time while my AOS pending.
Also, do I need to have an employment while re-entering using AP? I recently used my EP to re-enter but no question was asked about employment. I am thinking if I can use AP for re-entry if I travel outside while I am unemployed. I have to think about all this options as chaotic situation is going on the company and layoff might be inevitable.

Hello All,
I am starting my employment based GC process. My employer is going to file for my labour certificate (LC) thru PERM soon.
However, I want to know what happens if you Labour Application is not approved by USCIS?
like - Can you then apply for Labour thru another employer? or start ur Green Card process thru another employer.
- Can you get H1 extension after 6 year period is complete?
Kindly advice.

I just realized a stupid mistake was made after filing my COS from F1 to H1B. My employer sent the entire application this Monday to Vermont Premium Processing Center. I had no idea that the I-539 was not even needed and that I-129 and I-907 were sufficient enough to proceed with the COS. Anyway, is there a way to correct this error? I'm just hoping USCIS won't reject my application and just process my COS.
I included a separate check worth $300 to pay for the I-539 but the rest of the payments were issued by my sponsoring employer. I really thought I-539 was one of the requirements so I went ahead and included it.
Any input will be appreciated.

I am from India and currently visiting USA on B2 visa. I recently got a job with a very reputed firm in US and applied for an H1B but my application reached USCIS after the H1B quota was full.
I really want to work for my new employer and would like to know what other options do I have to obtain work permit in USA other than L1 Visa?

If it is a non profit research org or institute of higher education then H1 will not be counted towards quota. On the other hand if you have the credentials you can try for "O" VISA

The Senator Chuck Schumer (D-NY), the Immigration Subcommittee Chairman, told the AP yesterday that he plans on introducing a comprehensive immigration reform bill before Labor Day and then hopes to have a debate on the bill in the fall. Schumer hinted that advocates for highly skilled immigrants are likely to be happier with the bill than those pushing for guest worker reforms for lesser skilled workers and that business and the unions have yet to reach a compromise. I moved apartments and in the process unfortunately lost all my passport and visa documents. I do not have the original I-797 with me anymore. I have only a photocopy.
My I-797 was extended till may 2012 though my visa stamp on my passport expires this year. I was supposed to travel to India to get the visa stamped in May.
Can I still travel without an original I-797? What is the procedure? Can somebody please help?!!

Another thing I would like to mention. My I-140 got approved couple months back but applied I-485 during July 2007, so it's more then 180 days for I-485 not for I-140.
Any suggestion.

After we have filed for 485 and lets say we (me and my spouse) receive our EAD's. If I quit my job after 6 months of filing, can my spouse (secondary applicant) continue to renew her EAD's or would she have problems since I (the primary applicant) is no longer working for the company and maybe working for myself?

LCAs for consultatnts definitely are challenging, since they move around so much. In your case, a new LCA is not required because the new position is in the same Metropolitan Statistical Area (basically the same town) as the old location.
In general, CIS and DOL distinguish between employees who are roving as part of their job, and those who are sent to a new location for a short term. The distinction is too complicated to go into here, but hopefully your company's attorney is well aware of it.
