This is with regard to GC and h1
I have applied for family based GC above 21 yrs old on December 2006 and also currently holding h1 valid from October 2008. I also have my opt till May. Now since my employer was not able to find me a project he wants me to chg my status. I do not know what to do and how to chg my visa as, if I go on student visa I need to show financial documents and since I have not made any money how is it possible . If you can also suggest some schools who will not charge much or some courses which are not very expensive and time consuming and also where I can get work authorization as I will find jobs which are not technical and in line with my educational and work qualification . I have a deadline this evening as my employer just called me and told me this

I'm in the 8th year of H1-B, BEC priority date 04/2001, just got a notice that the case was closed ?? and the lawyer is working to reopen the case.
I have now a very good opportunity to work for another company, huge pay and benefits, a lot of pressure from this company to work for them.

In Nov 2006 company XYZ filed my GC.
H1B got transferred to a couple of companies because I changed jobs while GC was being processed in parallel without being affected by my job changes because it was filed by another company.
In Oct 2007 got my EAD for a period of 1 year. Kept working on H1B only though.
EAD expired in Oct 2008. Applied for a new card but never received it. Did not apply for one after that.
In Nov 2009, I quit my job and moved back to home country giving up my H1B while still not affecting my GC because company XYZ agreed to keep it under process.
So at this time, I have no H1B and no EAD card. My priority date is however going to be current soon.
Now...
1) Do I have to be in the country before my dates get current or can I do that later?
2) On what status do I enter?
3) Can I delay the process somehow without affecting my GC?

Honestly, what is the big deal here? Filing campaign finance reports electronically has been standard operating procedure for candidates for the House of Representatives and the White House for years -- as it has been for political parties, political action committees and "527" groups. Yet Senate candidates are still trudging down to the Senate Office of Public Records with paper copies of their reports, which are then passed along to the Federal Election Commission, which sends them to a vendor that punches in the information and zaps it back to the FEC electronically. That finally makes them widely available, sometimes too late for voters to see who's donating to whom and how the money is being spent. With this seeming fear of modernity, it's a wonder the Senate isn't calculating budgets with an abacus. Or is it a fear of disclosure?
After the bill was blocked, Ms. Feinstein, chairman of the Senate Rules and Administration Committee, said, "It is very hard for me to understand who could oppose this and what their reason for opposing it could be." Electronic filings would make the names of campaign donors readily available -- it's how members of the House and presidential candidates have been doing it for years. When Sen. Russell Feingold (D-Wis.) first brought the bill to the floor last week, though, he was told that an unnamed lawmaker objected.
Long-standing Senate custom allows the objection of a single senator to stop a bill in its tracks -- it's known as a secret hold. A measure that passed the Senate earlier this year, and awaits a House vote, would eliminate the practice.
The hold unleashed a torrent of activity on the Internet, as bloggers tried to flush out the identity of the senator responsible for the hold. But after an onslaught of phone calls to Senate offices, the bloggers have no answer. No one owned up to being the culprit.
Yesterday, the bill's sponsor tried again. And again, the Republican floor leader objected. A spokesman for Senate Minority Leader Mitch McConnell (R-Ky.) said he is sure the name of the secret senator is known "in the cloakroom," but he said that misses the point.
"A hold can't stop something from coming to the floor," Don Stewart said. "It can only stop it from being pushed through without a full and open debate on the bill."
That's true -- sponsors had been trying to pass the bill by unanimous consent, which does not permit amendment or debate. But Feingold told the liberal blog Daily Kos that the path was typical for a bill with 35 bipartisan co-sponsors that did not elicit a single objection in committee.
Writing on the blog yesterday, Feingold said: "The fact is that someone anonymously blocked the bill, . . . that person has made no effort to resolve his or her concerns with us, and the Republican leadership won't even tell us who that person is."

Hello ,
My EB3- 485 is pending from June 07. I am on H-1 and my employer decided not to file 7 th year extension and asking me to use EAD.
If I change employer using EAD (AC21) , can new employer file GC in EB2 (EB3 priority date 2005) ( not H-1 transfer)

I am working on EAD which I received from my EB3 category(labor date - Oct, 2004). My new employer filed a new application for EB2 category in Nov, 2010, my labor got approved within 3 months and they went for the next step filing my I-140 PETITION. They attached my previous I-140( from Eb3 category) along with the new application seeking to port the old priority date. Here is the REF which they received on 23, March 2011.
"Please provide evidence to show that the petitioner will be employing the beneficiary to fill the specific vacancy. In addition, provide a detail description of the work to be performed, including specific job duties, level of responsibility and number of hours per week of work to be performed.
You must sumbit the requested information within 30 days from the date of this letter. Failure to do so may result in the denial of your petition"
Please suggest. My attorney is working on this.

hI ATTY I am working under an h1b visa right now as of 2011. But i had a previous petitioned by another employer way back 2006. There was an I-140 filed but it was denied and I never heard from my petitioner then. I do have the USCIS copy and case number. Can I look for another employer and atty that could reopen the case?? If we could add some good things for legal immigrants (EB), and the bill gets passed in senate... what are the chances of getting it passed in house and reaching president's table. The reason for this concern is that same thing happened in Dec 05, when at the last moment all immigration stuff was reformed from budget recon. bill. I am sure IV must be thinking about this as well and would like to get IV team's views on this. Also wanted to thank IV team for taking so many efforts.

Call Customer Service. Phone no. is provided on any of your recipt notices. These is an option for typos on the document, when you call them. Tell them and they will open a Service Request, and update your name either when you go for fingerprinting or immedately. Mostly, they will open service request. You should also get an email confirming the Request made by you within few days (When I called for my typo, they said witin 45days, but got the mail within 15 days). Take that email with you if you get it before fingerprinting.
