Hi,
My wife's H4 was recently approved along with my H1. We both have different last names. My name is misspelled, an "a" missing and her middle initial is also different. What can I do to get a corrected H4? Can I go to local immigration office or something? My lawyer contacted the USCIS and they said they will respond in 45 days. They don't even guarantee that they will correct the approval document.
Please let me know

When I got back from overseas travel this time, at San Francisco, the Customs person took both my AP's and stamped one and gave it back to me and kept the other with him.
I remember previously when I had two AP's one was stamped and the other was returned unstamped.
My AP was multiple entry both times.
I need top travel again next month. Any idea if I can travel on my current stamped AP or there is a problem.

Dear Attorney,
I am on L1B visa and valid until Oct2010; I somehow decide to apply for green card with certain personal reason.
As I understanding, the employer will file the green card petition for me. I'd like to what's the difference between filing from lawyer ("Duration"), because I am ready to hire a lawyer to file that for myself if it can shorten the duration to obtain a green card. What's the time range it will be processed from L1B to greencard?
My only concern is if it is a shortcut (duration) to file green card petition from lawyer instead of employer.

Well, if you leave your co. now and also want your GC then:
Your H1 period will be over after 6 years irrespective of the I-140 from the old co.
GC: You do have to start from scratch.
However, you can still maintain your PD if your prev. co does not revoke the I-140. The documentation of your Old PD is to be attached with the New I-140.

Yes. The petition will be like a regular change of employer H-1B petition. The lawyers will tell you what documents they need from you when filing the company's H-1B petition.

This may seem strange and confusing. Here is my case
I changed my employer from A to B with an intention of taking advantage of an existing approved labor with employer B. I applied for I-140 and H1B transfer at the same time in March 2007. I-140 was approved in June 2007. In July 2007, I applied for EAD and 485. Meanwhile, I got an RFE for H1b transfer and my attorney responded to this in time. I got my EAD approval in Sep 2007 and got FP done before my I-94 (thru company A) expiration in Nov 2007. I got a denial notice for my H1B on Nov 13 2007. My attorney missed the appeal date so no appeal has been filed for the H1B denial.
Here are my questions:
- Am I currently out of status since my I-94 expired in Nov 2007?
- If I am not out of status, what is the next course of action I should be taking?
- Will there be any issues when i try to renew my EAD?

I got my H1 approved in Oct 2004 and it was from Oct 2004 - Oct 2007. I used only 6 months of H1 and later went on TN (work visa for Canadian citizens) and remained in US working on TN for 4 years. I was in US all these years. Now even the earlier H1 approval duration is over, Can I apply for H1 with another employer using the old 2004 H1 quota cap or it has to be under new 2009 cap? Thanks in advance.

Holding an I-20 doesnt mean anything if you dont enroll for the required minimum credit hrs...You have to enroll....

I am planning to travel via BA from DC to Bangalore and travel back from Bangalore to DC through Lufthansa.
I have my AP doc. I know Lufthansa is fine with an AP while I travel from Bangalore to DC visa Frankfurt.
Will I need a transit visa to travel through London to India (one-way)? I have a valid Indian passport and am on Advance Parole.
