One of my co-workers had similar situation. He had PD in 2001 on EB3.
He talked to his employer to port to EB2. Porting process/approval took about a year but after that it took only 2 months to get approval.
You should be able to switch from EB3 to EB2.
Put pressure on employer or get some other company (reputed one) to take a AC21 and start processing EB2.

i wanted to aviod posting this, but please include a bit of realism in your optimism. Full disclosure: i am EB 3-I
We had a discussion on our chapter here is the extract of the email that i sent based on a couple of similar comments from fellow members.
After talking to a few of the fellow members, i feel that one the main causes for inaction is that folks who have applied under EB 2 India feel that the spillover from ROW EB 2/1 and India EB1 will be sufficient to get them their GC's in 2 years tops. EAD/AP for two years is no big deal. There is no urgency to get things done or the motivation to step up to the plate and make a few calls. If that is the case, then chances are that you are mistaken.
a) we have no estimate of the per country breakdown of pending applications.
b) we have no idea how many EB2 India applied in July 07
c) we dont know the number of multiple applicants who have EB2 and EB3 applications pending (spouse and self).
d) We have no indication of the 300k applications who were stuck in namecheck and are now eligible for approval. Namecheck victims were from all countries (you can see that ROW EB 3 is U)
This affects ROW as well as the retrogressed countries as the per country quota is still fixed.
We cannot wish this mess away. Making a few phone calls at lunch should not be a big deal.
I am Not sure everybody follows Federal Reserve revising short-term rates by every month and Financal analyst were trying to understand language(tone) of Bulletin. And Looking at tone of VISA Bulletin for July 2008 and historical Bulletins EB2 for India is very encouraging till we see the language next month for India.

Canot DOL/ UCIS make a judgement based on their own ?
You don't want USCIS to make any judgement. Here is an example of their judgement.
USCIS said that 140K EB #s were used on July 2. However, we are hearing that they did not use up the numbers on Sep 30.

I applied I-485/EAD/AP on July 24th at Nebraska. Have received EAD and FP done but AP is still pending.
I noticed couple of soft LUDS on my I-140 (which was approved in Dec, 2006) and I-485 in last few days but nothing on AP. My PD is Oct, 2005 ROW.
Still waiting.......

Does it mean the eligibility criteria/job requirement for EB2 is changed from Bachelors + 5 years of experience to Bachelors + 10 years of experience?
This line is not good:

Thanks!. There were some skeptics on IV Forums who didn't believe that USCIS worked over weekend to approve 25,000 visas. :mad: Some people genuinely believed that USCIS made a clerical error in calculating visa number or some other nonsense excuse. Those who don't believe that this indeed is a scandal,should read Logiclife's excellent analysis on June 29th where he explains -how retrogression is NOT possible.

In Jan 2010 DOL will publish their data and that will make thing very clear. I think DOS is assuming around 10 -15 k Spill over visas that can be available to Eb2 India ( based on previous years ) and that is what it take them into Oct - Dec 2005 range. They don't factor in CIS processing time. But I think from pool of 40-50k pre adjudicated apps CIS can easily consume 10k visas. But if there are less labors and more spill over visas ( like 30 -40 k) then be ready for mini version of july fiasco.

I got my loan approved in April 2010 from Wells Fargo, the under writer created some problems but my loan officer gave them references of prior loans getting approved for people on AOS so it worked out well in the end. I know a lot of people who's loans were approved (both conventional and FHA) and were on AOS. All the best hope everything works out well for you.

I sent I-140, EAD copy for immigration documents. just got email from loan office that he received my file back from underwriter and ask for greencard copy front and back as underwriter said EAD is not acceptable (Employer can not sponsor borrower).

Not sure about which bank would be good but whichever bank you choose make sure that they give you a statement of how much interest you paid over the year. Most people don't realize that you can deduct interest paid for a home loan in India is tax deductible in the US. Just FYI.

I got an email saying that "On December 2, 2010, we ordered production of your new card" today. Me and my wife both got emails. Our wait (green in our life) for so many years came to a very happy end. My hearty wishes to all the friends who have been waiting in the queue to have best of luck.
