Hi,
I am lost trying to find information on this.
Here's the situation for adding my wife to my I-485 application (we are from India). We DO have her 100% correct birth certificate we got issued last month.
However, since the issue date on it is April 2011, our lawyer insists that we need affidavits from her parents as well (perhaps to avoid RFEs). Further the lawyer insists that the Foreign Affairs Manual for India states that these be sworn in front of a first class magistrate of India.
When her parents went to the local court and request the first class magistrate, the court officer is demanding that we have a sealed copy of the requesting authority (USCIS) that clearly states that a first class magistrate's signature is required!
Questions:
(i) Is the affidavit supposed to be sworn in front of first class magistrate? Even if we have a corrected birth certificate?? Or can it be signed by an 'Executive Magistrate' or maybe even just notarized??
(ii) If yes, did someone else face a similar issue?
(iii) If yes, is there a USCIS document I could send to satisfy their demand?
I did try to find a USCIS document but all it states is that ... IF the birth certificate is unavailable ... then "sworn affidavits" need to accompany non-availability certificate from a competent local government authority.

There are easily 100000 of us here in the line. If we are all given GC's would it work in the national interest?
Specifically, there are three tests for national interest. Refer to this link for a more comprehensive explanation:

Hi
After waiting for a year for my FP notices and 4 SRs later I guess I took the infopass and went to the local office. The guy out there was quite nice and helpful and gave me the appointment for next day at the local ASC promptly.
Went to the local ASC and was was done in half hour. No issues.....it was a breeze...shd have done it sooner....
And here is the best part: My application had an LUD just 3 hours later.....

I am not aware of any required time while in adjustment of status. There is on GC but not in AOS pending

There is nothing like losing. If it expires, you will have to renew it.

Due to Iceland's volcanic ash my MIL trip has to be postponed. She was on visitor visa. We filed an extension with USCIS and paid $300. She left US as soon as flights started to resume.
USCIS approved her extension 30 days after she left US.
a) Can we seek a refund because this extension has to be filled due to reasons beyond our control
b) In the future how to seek a fee waiver (any tips or advice please).
c) Can we seek fee waiver when we e-file a petition.

IO discretion.
My in-laws came in Apr'08 to US and left in Oct-08 for India. They then came back again in Dec'08 due to some issues and they had no problems - they again stayed nearly for months.

I haven't had "any" FP yet, but I have my EAD and my advanced parole for tavel. I also have my H1B current and stamped in my passport.
Last time I got H1B stamped in the embassy, they took my fingerprits, 10 fingers (I also asked if they want the 10 toes :D)
Can that fingerprinting in the embassy be the reason why they haven't sent any notices for my fingerprinting?
Should I be worried?
Can somebody, please, tell me how do you ask for a service request?

Did they take the print of your four fingers (excluding the thumb) together? If not, then the fingerprinting you underwent was not the same.

My EAD card was returned as undeliverable as Mail Box didn't have my name on it.
I changed my address and requested the Card to be resent. CSR said it would take 3-5 business days.
I spoke with a IIO today and she said it would take 4- 5 months to get remailed as per their policy.
Which one is right ,CSR/IIO?
Is there anything that I could do to get my card earlier?

Hi All,
I had a question regarding the relationship between the number h1b transfers and green card process. I've heard some people say that if you have transferred H1b to many companies then the green card process will be delayed because USCIS needs to be convinced that you will be continuing with the same employer. Is this true or does it really not matter how many times you change employers it doesn't effect the green card process.
I have already transferred once. I am thinking of transferring one or possible two more times but am just worried about how this will effect the green card application process.

Guys any suggestions? How long does it take to produce the cards these days? I've seen many approvals where they get the cards within days. Pretty confused about this.

I had a hard time to get dates in Punjabi for my parents...after trying for many days...finally found some one paid him Rs XXXX and got the desired date time within 1 hour. This is not the right way but I had no other option.

I applied for I 485 , AP and EAD during 07 July. I got a fp notice back in 2007 and I got another one two weeks ago. I went ahead and did my bio-metrics over the weekend at TSC Application Support Center.
Does this mean that somebody has looked into my file and pre adjudicated it? or is it a automated thing and does not mean anything?

Sorry for the delay in replying to this. I'm looking into this right now, and hopefully I'll have an answer by tomorrow :)
